Bankruptcy consultation shouldn’t be like “Texas Hold’em”

Q:  “Why Do you Want All these Forms Filed Out for our Bankruptcy Consultation?” A:  “Because you and I should not play Texas hold’em.” I’ve never played Texas hold’em.  But I’ve seen it on TV.  Maybe you have, too. Each players has their own cards–then the cards dealt in the middle face down are turned […]

Debt Collectors will be on you like a duck on a junebug

This article in the Norfolk paper about Portfolio Recovery explains something I had only guessed at, before.  Debt collectors know when your finances improve.  Debt collectors pay the credit bureaus to tell them. I’m a Virginia bankruptcy attorney, and I know people want to put off filing bankruptcy for as long as possible. Some people come […]

Overtime Charges and the Legal Fee for Chapter 13

What’s the Legal Fee for Chapter 13 in Virginia? People ask all the time, what’s the legal fee for Chapter 13? That should be easy, but it’s tough.  Here’s my attempt at a straight answer. The fee I charge you in chapter 13 is set in two ways.

A New Start In Life–Out of the Depths of Dispair

Three years after bankruptcy–from the depths of despair to building a retirement home. I love being a bankruptcy lawyer, because I can help almost everyone I see. Just before the July 4 Holiday, while I was rushing to wrap up some work,  this email came from a a friend I’ll call John Blackstone.

Bankruptcy Means Test: 5% Additional for Food and Clothing

Food and clothing in the bankruptcy means test One of my jobs as a bankruptcy lawyer is to make you look good on the bankruptcy means test. Here in Northern Virginia, I claim an extra 5% on your food and clothing allowance.  The bankruptcy means test law talks about that 5% in 11 USC 707(b)(2)(A)(ii)(l).

Chapter 13: Your vehicle operating budget is too small.

If you are in Chapter 13, the vehicle operating budget you are allowed will be too small. That’s (almost) a mathematical certainty.   Here’s why. The census bureau shows–no surprise–that people who are working spend on average double on transportation gasoline and maintenance than people who aren’t.

Settlement Agreements, Confidentiality and Non-Disparagement

Bob needs to do a blog on this. Here’s this on confidentiality. http://www.scbar.org/MemberResources/EthicsAdvisoryOpinions/OpinionView/.... It’s an ethic violation for lawyer to sign–client can sign and direct lawyer to keep his mouth shut.

Dismissed Chapter 13

Sometimes a dismissed Chapter 13 is all your need. Chuck and Inez came to see me today about Chapter 7 bankruptcy. I had put Inez in a Chapter 13 in December 2011 when their house was days away form foreclosure.   The Chapter 13 was dismissed six weeks later. BUT, that short Chapter 13 had […]The post Dismissed Chapter 13 by Robert Weed appeared first on Robert Weed.

Freedom Debt Relief: Claims on the Radio–Are They True?

Heard a commercial last week for Freedom Debt Relief on WTOP. They said that Freedom Debt Relief offers a “unique” alternative that will save “the most money” and get people out of debt in the “shortest amount of time.” I’ve sued a couple debt relief operations, most notably Legal Helpers Debt Resolution.

Can a Debt Collector Call Itself “Law Enforcement Systems”?

I think it’s an FDCPA violation for a debt collector to call itself Law Enforcement Systems. One of my bankruptcy clients brought me a bill from an outfit called Law Enforcement Systems. The bill as for $100.65.  That’s 65 cents for a toll they say she didn’t pay.
